Tri-Acre Farm & Co - North Carolina Herd Share Agreement

This Herd Share Agreement ('Agreement') is entered into on the day selected below, by and between Tri-Acre Farm & Co ('the Farmer') and the undersigned Shareholder.
1. Purpose
This Agreement allows the Shareholder to purchase an ownership share in the goat herd owned by Tri-Acre Farm & Co, thereby receiving a proportional amount of milk from that herd. This is not a sale of raw milk; it represents joint ownership of the herd and payment for its care.
2. Herd and Ownership Interest
• Herd: Dairy goats owned and managed by Tri-Acre Farm & Co at the above address.
• Half (1/2) herd share entitles the Shareholder to half (1/2) gallon of raw goat milk per week.
• One (1) herd share entitles the Shareholder to one (1) gallon of raw goat milk per week.
• Buy-in cost: $65.00 per one (1) herd share (one-time payment and non-refundable).
• Ownership continues while this Agreement is in effect.
3. Boarding and Maintenance Fee
The Shareholder agrees to pay $30.00 per month per one (1) share, for the care and maintenance of the herd. This is not payment for milk.
4. Milk Distribution
• Pickup on-farm at 510 Moon Circle, Salisbury, NC 28147.
• Scheduled pickup day will be arranged between Tri-Acre Farm & Co and the Shareholder.
• Shareholder provides clean containers unless otherwise arranged.
• Milk Production Variability: The Shareholder acknowledges and understands that milk production from dairy goats naturally fluctuates throughout the year due to factors such as breeding cycles, weather, nutrition, and the natural lactation period of the animals. As a result, the quantity of milk available to Shareholders will vary and may increase or decrease at different times of the year.
Tri-Acre Farm & Co makes no guarantee of a fixed quantity of milk per share on a daily, weekly, or monthly basis. During periods of low production, milk may be available at lesser quantities to Shareholders or temporarily unavailable. These variations are a normal part of dairy goat management and do not constitute a breach of this Agreement.
5. Duration and Termination
This Agreement remains in effect until canceled by either party with 30 days' written notice preferred.
6. Health and Legal Disclaimers
Raw milk may contain harmful bacteria that can cause illness, especially in children, the elderly, pregnant women, and persons with weakened immune systems.
By signing this Agreement, the Shareholder acknowledges that:
• Raw milk is not pasteurized and may contain microorganisms that cause illness.
• This herd share is a private ownership arrangement, not a retail sale.
• The Shareholder voluntarily assumes all risks associated with handling or consuming raw milk.
• Tri-Acre Farm & Co makes no warranties, express or implied, regarding the safety or fitness of raw milk.
7. Liability Waiver
The Shareholder agrees to hold harmless and indemnify Tri-Acre Farm & Co, its owners, agents, and employees from any and all liability arising from participation in the herd share or consumption of milk obtained through it.
8. Entire Agreement
This document constitutes the entire Agreement between the parties. Any changes must be in writing and signed by both parties.
